HYEHOST LLC Terms of Service Last updated: October 25, 2026 Document version: 3.1 Official public URL: https://hyehost.org/tos Company: HYEHOST LLC, Charter No. LC014522786 Important Arbitration Notice THIS CONTRACT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES. EXCEPT WHERE APPLICABLE LAW PROVIDES OTHERWISE OR YOU VALIDLY OPT OUT, SECTION 31 REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND INCLUDES A CLASS ACTION WAIVER AND A JURY TRIAL WAIVER. These Terms of Service (the "Terms") govern the relationship between HYEHOST LLC (the "Provider," "Company," or "HYEHOST") and every person or entity that accesses, orders, receives, or uses a HYEHOST service (the "User," "Customer," or "you"). By creating an account, placing an order, accepting a quote, paying an invoice, clicking to accept these Terms, or accessing or using any Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, do not create an account, place an order, or use the Services. 1. Agreement, Scope, and Order of Precedence 1.1 Services Covered These Terms apply to all services supplied by HYEHOST, including: Web, WordPress, shared, reseller, and free hosting; Paid and free bot hosting; Virtual Private Servers, Virtual Dedicated Servers, and other virtualized compute services; Dedicated servers, bare metal services, managed clusters, and managed Proxmox services; Storage VPS, storage boxes, file storage, backup storage, and related storage services; Colocation and remote-hands services; IP transit, BGP sessions, network tunnels, DNS services, reverse DNS, and related network services; IPv4 and IPv6 address space supplied, routed, leased, sponsored, or managed by HYEHOST; Software-as-a-Service, control-panel, automation, and account-management services; and Any other product, add-on, feature, trial, promotion, or service supplied by HYEHOST. These are collectively referred to as the "Services." 1.2 Service Order A "Service Order" means the order confirmation, checkout page, accepted quote, invoice, signed order form, plan description shown at purchase, or other written record that identifies the Service, price, billing cycle, location, resources, included features, and any service-specific conditions. 1.3 Additional Policies The HYEHOST Privacy Policy, Acceptable Use Policy provisions in these Terms, service-specific policies, plan limits, and any written Service Order form part of the agreement between you and HYEHOST. 1.4 Order of Precedence If documents conflict, the following order applies, with the first item taking priority: A separately signed agreement, Data Processing Agreement, or Service Level Agreement that expressly overrides these Terms; The applicable Service Order; A service-specific policy or addendum expressly incorporated into the Service Order; These Terms; and Website summaries, advertisements, help articles, or other general marketing material. A feature, limit, backup, support level, SLA, or other commitment is included only when it is stated in the applicable Service Order or another higher-priority document. 1.5 Authority to Accept If you accept these Terms for a company, organization, partnership, government body, or other legal entity, you confirm that you have authority to bind that entity. In that case, "you" includes both you and that entity. 2. Eligibility, Registration, and Account Verification 2.1 Minimum Age The Services are intended for persons aged 18 or older. You must not create an account or use the Services if you are under 18. 2.2 Accurate Information You must provide complete, current, and accurate account, identity, contact, company, payment, and billing information. You must promptly update that information when it changes. You must not: Use a false name, false address, disposable identity, stolen identity, or misleading company information; Impersonate another person or entity; Conceal the person or entity that controls or benefits from the account; Use payment details without the account holder's authorization; or Create additional accounts to avoid restrictions, unpaid balances, fraud checks, suspensions, or bans. 2.3 Verification and Anti-Fraud Checks HYEHOST may require identity, address, company, payment, source-of-funds, IP-ownership, ASN-ownership, or authorization checks before or after provisioning a Service. Where an account was created with false, inaccurate, or suspicious information, HYEHOST may require payment verification using a bank account or payment card registered to the exact legal name and billing details used on the HYEHOST platform. HYEHOST may request documents or information that reasonably support an order or network request, including government identification, proof of address, company records, payment evidence, a Letter of Authorization, RIR records, IRR objects, ROAs, or proof that you are authorized to use an ASN or IP prefix. Failure to complete a requested verification within the stated time may result in delayed provisioning, order rejection, suspension, termination, or refund to the original payment method where appropriate. 2.4 Sanctions and Legal Restrictions You must not use the Services if doing so would cause HYEHOST to violate any applicable sanctions, export-control law, court order, or other legal restriction. HYEHOST may screen accounts and transactions and may refuse, block, suspend, or terminate a Service where reasonably required for legal or compliance purposes. 2.5 Refusal of Service HYEHOST may refuse registration, reject an order, limit available payment methods, or decline to provide a Service where there is a reasonable concern involving fraud, abuse, sanctions, technical incompatibility, lack of capacity, payment risk, prior misconduct, or legal compliance. 2.6 Account Ownership and Transfers The verified person or entity shown in HYEHOST billing records is treated as the account owner. HYEHOST may rely on payment records, identity verification, account history, and other evidence when resolving an account-ownership dispute. You must not sell, transfer, assign, or give control of an account or Service to another person without HYEHOST's prior written approval. HYEHOST may require the new owner to complete verification and accept these Terms. 2.7 Contact Details You must maintain a working email address and review account, invoice, support, and abuse notifications. A notice sent to the email address registered on the account is treated as received when sent, except where applicable law requires another method. 3. Changes to These Terms and the Services 3.1 Changes to Terms HYEHOST may update these Terms to reflect legal requirements, security needs, new products, abuse trends, operational changes, or changes to third-party services. Updated Terms will be published at the official public URL with a revised update date. Material changes may also be notified through the account email address or client area. Unless an earlier effective date is required by law, security, fraud prevention, or urgent abuse handling, material changes apply on the stated effective date. Continued use of a Service after that date constitutes acceptance. 3.2 Changes During a Paid Term HYEHOST will not intentionally remove a material paid feature during an active prepaid term unless the change is reasonably required for security, legal compliance, abuse prevention, third-party availability, infrastructure safety, or continued operation of the Service. Where HYEHOST permanently discontinues a paid Service for convenience and the User is not in breach, HYEHOST may offer a replacement Service, account credit, or a prorated refund for the unused prepaid period. Nonrecoverable third-party, licensing, hardware, setup, custom-order, and transaction costs may be excluded. 3.3 Changes to Arbitration Terms A change to Section 31 will not apply to a dispute for which either party had already sent a written Notice of Dispute before the change took effect, unless both parties agree otherwise. 3.4 Free and Beta Services HYEHOST may change, limit, suspend, or discontinue a free, trial, promotional, preview, or beta Service at any time, with or without notice. Section 23 contains additional terms for those Services. 4. Orders, Pricing, and Provisioning 4.1 Order Acceptance Submitting payment or receiving an automated confirmation does not require HYEHOST to accept an order. An order is accepted when HYEHOST provisions the Service or confirms acceptance in writing. HYEHOST may cancel and refund an order before provisioning where the Service is unavailable, incorrectly priced, technically unsuitable, affected by fraud risk, or cannot lawfully be supplied. 4.2 Pricing Errors HYEHOST may correct an obvious pricing, specification, tax, currency, or configuration error before provisioning. If you do not accept the corrected terms, the affected order will be canceled and any collected payment for that order will be returned, subject to payment-processor limitations. 4.3 Provisioning Times Provisioning times are estimates unless a written Service Order guarantees a deadline. Automated Services may provision quickly, while dedicated servers, colocation, custom hardware, network services, IP space, and manual reviews may take longer. HYEHOST is not liable for a provisioning delay caused by verification, payment review, parts availability, a data-center provider, an RIR, an upstream network, licensing, a third party, or another matter outside HYEHOST's reasonable control. 4.4 Locations, Hardware, and Addresses A specific data-center location, processor model, storage medium, network carrier, IP range, IP geolocation, or other technical characteristic is guaranteed only when the Service Order expressly identifies it as guaranteed. HYEHOST may move a virtualized workload within the same advertised region or to equivalent infrastructure where reasonably required for maintenance, capacity, security, or fault recovery. 4.5 Custom Orders A custom order that requires HYEHOST to purchase hardware, parts, licensing, transit, cross-connects, IP resources, installation work, or another nonrecoverable item cannot be canceled after HYEHOST has made the purchase or commitment. Setup charges, custom engineering charges, remote-hands charges, and nonrecoverable third-party charges are non-refundable unless HYEHOST agrees otherwise in writing. 4.6 Compatibility You are responsible for confirming that a Service is suitable for your intended operating system, software, network design, protocol, licensing model, and workload before ordering. HYEHOST is not responsible for a Service being incompatible with software, a third-party platform, or a design that was not disclosed and approved in writing before purchase. 5. Customer Responsibilities, Content, and Security 5.1 Responsibility for Use You are responsible for all use of your account and Services, including use by employees, contractors, customers, resellers, end users, API keys, scripts, applications, and any person who gains access through your credentials or systems. A breach by an end user is treated as a breach by the account holder. 5.2 Customer Content You retain ownership of data, software, websites, messages, files, virtual machines, configurations, and other material that you upload, transmit, store, or process through the Services ("Customer Content"). You grant HYEHOST a limited, non-exclusive license to host, copy, transmit, cache, process, back up where included, and otherwise handle Customer Content only as reasonably necessary to provide, secure, maintain, troubleshoot, and enforce the Services and these Terms. 5.3 Rights and Permissions You confirm that you have all rights, permissions, licenses, and lawful bases needed to use, store, transmit, and process Customer Content and personal data through the Services. You are responsible for notices, consents, privacy obligations, records, licenses, and contracts required for your users, customers, staff, and data subjects. 5.4 Account and System Security You must: Use strong, unique passwords and enable multi-factor authentication where available; Protect API keys, console access, recovery codes, private keys, and control-panel credentials; Secure and patch operating systems, applications, websites, plugins, scripts, and control panels under your control; Disable unused accounts and services; Maintain appropriate firewall, access-control, malware-protection, and logging measures; Notify HYEHOST promptly if you suspect unauthorized access or compromise; and Cooperate with reasonable security and abuse investigations. HYEHOST is not responsible for loss caused by weak credentials, unpatched software, exposed management interfaces, insecure scripts, compromised third-party applications, or another matter under your control. 5.5 Software Licensing You must obtain and maintain all licenses required for operating systems, control panels, databases, applications, media, fonts, software, and other content installed or used on the Services. HYEHOST may suspend or remove unlicensed software where required by a rights holder, licensor, court, or applicable law. 5.6 High-Risk Uses The Services are not designed or certified for life-support systems, emergency dispatch, aircraft control, nuclear systems, medical devices, or another use where a Service failure could reasonably cause death, personal injury, or major physical damage. You must not use the Services as the sole system for such a purpose. 6. Backups, Data Responsibility, and Deletion 6.1 Backups Are Not Included by Default Backups are not included with any Service unless the applicable plan description or Service Order expressly states that backups are included, or you have purchased and activated a separate backup add-on. The existence of storage redundancy, RAID, replication, snapshots, spare disks, disaster-recovery systems, or internal infrastructure copies does not mean that a customer backup service is included. 6.2 Plan and Add-On Terms Control Where backups are included or purchased, the Service Order controls the backup frequency, number of backup slots, retention period, storage limit, restore method, and any restore charge. A reference to "one backup slot" means only that up to one backup or restore point may be retained at a time. It does not promise a particular backup schedule, age, retention period, or successful restoration unless those details are also stated in the Service Order. A backup add-on begins only after it has been ordered, paid for, provisioned, and confirmed active. It does not create backups for any earlier period. 6.3 Disaster-Recovery Copies HYEHOST may maintain internal copies for its own infrastructure recovery. Unless a Service Order expressly grants customer restore rights, those copies are not part of the purchased Service, may not contain current Customer Content, may not be retained for any fixed period, and may not be available for an individual restore request. 6.4 No Backup Guarantee Any backup or restoration supplied by HYEHOST is provided on a reasonable-efforts basis. Backups may fail, be incomplete, become corrupted, contain malware or encrypted data, be outside the desired recovery point, or become unavailable because of hardware failure, software failure, deletion, capacity limits, security incidents, or other causes. HYEHOST does not warrant that a backup will be created, retained, readable, complete, free from malware, or capable of restoration. 6.5 Customer Backup Duty You must maintain current, tested, independent backups stored outside the affected HYEHOST Service and, where practical, outside the same HYEHOST account and infrastructure location. You must test your own restore process and must not rely on HYEHOST as the only location for important or irreplaceable data. 6.6 Restores A restore request may require: An active Service in good standing; Available backup data; Identity or account verification; Sufficient destination storage; Payment of any applicable restore or engineering charge; and Acceptance that existing destination data may be overwritten. A restore request does not extend a backup retention period. HYEHOST may delete an expiring backup before a delayed or unpaid restore request is completed. 6.7 Suspension, Cancellation, and Termination You are responsible for exporting all required data before a Service is suspended, canceled, expired, reclaimed, or terminated. HYEHOST may restrict data access during suspension. Once a Service is terminated, its disks, virtual disks, account files, backups, snapshots, and related data may be deleted or securely overwritten immediately or within the service-specific timeline in these Terms. HYEHOST has no obligation to preserve Customer Content after termination, non-payment, fraud, chargeback, or a serious policy violation. 7. VPS, VDS, and Virtualized Compute Services 7.1 Management Level VPS, VDS, and virtualized compute Services are unmanaged unless the Service Order expressly states that they are managed. You are responsible for operating-system administration, updates, security, applications, data, firewall rules, and configuration on an unmanaged Service. 7.2 Resource Usage Virtualized resources are subject to the limits shown in the Service Order and the fair-use provisions in Section 21. You must not use CPU, memory, storage I/O, network I/O, processes, or another shared resource in a way that materially affects the host node, platform, network, or other users. HYEHOST may throttle, limit, migrate, reboot, suspend, or require an upgrade where a workload causes instability, sustained contention, or excessive shared-resource usage. 7.3 Maintenance and Migration HYEHOST may live-migrate, stop, reboot, or move a virtual machine where reasonably required for host maintenance, security, capacity management, emergency repair, or infrastructure replacement. 7.4 Backups VPS and VDS backups are governed by Section 6. No backup is included unless the plan or Service Order specifically lists it or a backup add-on has been purchased and activated. 7.5 Email and SMTP Ports Virtualized Services using HYEHOST-provided IP space or a prefix originated by a HYEHOST ASN are subject to the permanent email-port restrictions in Section 13.3 and Section 20.5. The customer-prefix exception in Section 13.4 applies only where the prefix is owned or lawfully controlled by the customer, originated in BGP by the customer's own ASN, and merely carried in transit by HYEHOST. 7.6 Linux-Only Plans A plan described as Linux-only, including an applicable budget VPS or cloud VPS plan, may be used only with a Linux operating system. Installing, deploying, or attempting to install Windows or another non-Linux operating system on a Linux-only plan is a direct breach and may result in immediate suspension or termination without refund. 7.7 Operating-System and License Responsibility Where HYEHOST supplies an operating-system image, you remain responsible for configuring, securing, updating, and licensing the installed system unless a managed Service Order states otherwise. 8. Dedicated Servers, Bare Metal, and Managed Infrastructure 8.1 Management Level Dedicated servers and bare metal Services are unmanaged unless expressly sold as managed. Managed clusters and managed infrastructure include only the tasks and response commitments listed in the Service Order. 8.2 Data and Reinstallation You are responsible for all data and configuration on a dedicated server. An operating-system reinstall, disk replacement, RAID rebuild, reimage, reprovision, or secure wipe may permanently erase data. HYEHOST will not perform a destructive action requested through a verified account without treating that request as authorized. 8.3 Backups Dedicated servers, bare metal Services, and managed infrastructure do not include backups unless the Service Order expressly lists backups or a separate backup add-on has been purchased and activated. 8.4 Hardware Faults HYEHOST will use reasonable efforts to diagnose and replace failed provider-owned hardware. Replacement time depends on fault confirmation, access, parts, staffing, data-center rules, and supplier availability. Hardware replacement does not guarantee data recovery. Any uptime credit applies only where a written SLA covers the event. 8.5 Availability and Custom Configurations HYEHOST cannot guarantee stock or availability for every server configuration. Provisioning times may vary. Custom orders that require parts, hardware, licensing, cross-connects, transit, or other purchases cannot be canceled once HYEHOST has made the relevant purchase or commitment. 8.6 Remote Hands and Recovery Work Work outside the support included in the Service Order, including custom cabling, data recovery, application repair, operating-system repair, file restoration, or on-site remote hands, may be refused or charged at the current rate. 8.7 End of Service When a dedicated or bare metal Service is terminated, HYEHOST may reassign the hardware and erase its disks within hours. A terminated dedicated server cannot normally be reinstated. 9. Web, Shared, WordPress, and Reseller Hosting 9.1 Management Level Web hosting is managed or unmanaged only as stated in the Service Order. Unless a plan is expressly described as managed, support is limited and does not include website development, code repair, plugin repair, content changes, search-engine work, or third-party application support. 9.2 Resource Limits Shared and reseller hosting is subject to the CPU, memory, process, inode, storage, database, email, and network limits shown in the plan or control panel. HYEHOST may limit or suspend an account that affects server stability or other users. 9.3 Reseller Responsibility A reseller is responsible for its customers and end users, including support, billing, account security, Customer Content, and compliance with these Terms. HYEHOST may suspend an individual reseller account or the entire reseller Service where an end user causes abuse, security risk, or excessive resource usage. 9.4 Backups Web, shared, WordPress, free, and reseller hosting do not include backups unless the plan or Service Order expressly states that backups are included or a backup add-on has been purchased and activated. 9.5 Financial Schemes and Investment Content Free and paid hosting plans must not be used to offer, operate, advertise, facilitate, or promote: Investment schemes; Cryptocurrency investment, trading, staking, mining-return, yield, token-sale, or similar schemes; High-yield investment programs; Ponzi, pyramid, referral-investment, doubling, recovery, or advance-fee programs; or Any similar financial program that is unlicensed, misleading, suspicious, fraudulent, or unlawful. Fraud, spam, illegal activity, misleading claims, fake testimonials, false company details, guaranteed-return claims, and suspicious investment websites are prohibited. Where an account was created using false or inaccurate information, the account holder may be required to verify payment details using a bank account or payment card registered to the exact legal name and billing details used on the HYEHOST platform. If HYEHOST identifies content or activity that breaches this subsection or another part of these Terms, HYEHOST may remove the Service or account without warning and permanently block the account holder from using HYEHOST again. 10. Bot Hosting, Including Free Bot Hosting 10.1 Intended Use Bot hosting is intended solely for legitimate bot scripts, automation scripts, application workers, and related programs that comply with these Terms and the rules of any third-party platform they use. 10.2 Prohibited Uses Paid and free bot hosting must not be used to: Operate or provide an HTTP, HTTPS, SOCKS, residential, public, private, rotating, or other proxy service; Operate or provide a VPN, tunnel, anonymization service, traffic relay, port forwarder, exit node, or service that forwards or disguises third-party network traffic; Send email or operate an SMTP relay, mailing service, newsletter service, bulk-mailing system, email-marketing system, or similar email function; Send spam, unsolicited messages, abusive automated messages, or platform abuse; Operate credential-checking, scraping, account-creation, token-abuse, raid, self-bot, or other automation that breaches law or a third-party platform's rules; Evade HYEHOST limits through multiple accounts, scripts, containers, or identities; or Conduct illegal, malicious, fraudulent, abusive, or disruptive activity. 10.3 Immediate Termination Any use of bot hosting for a proxy, VPN, tunneling, traffic-relay, anonymization, port-forwarding, or mailing purpose will result in immediate termination of the bot-hosting Service without warning. HYEHOST may also suspend or terminate the associated account and other Services where the conduct is serious, repeated, fraudulent, or part of a wider breach. 10.4 Free Bot Hosting Free bot hosting has no uptime commitment, backup commitment, data-retention commitment, or support SLA unless the Service Order expressly states otherwise. HYEHOST may require periodic renewal, activity, verification, or acceptance of updated limits. Inactive, expired, duplicate, or abusive free bot Services may be reclaimed and deleted without notice. 11. Storage Services and Storage Boxes 11.1 Intended Use Storage Services are intended for lawful file storage, backup targets, synchronization, transfer, and related storage workloads within the purchased quota and protocol limits. 11.2 Redundancy Is Not a Backup Storage redundancy, RAID, replication, checksums, or multiple disks do not replace an independent backup. A Storage Box or storage Service may itself be used as one part of your backup plan, but you must maintain another independent copy where the data is important. 11.3 Included Backups and Snapshots HYEHOST does not back up a Storage Service or Storage Box unless the Service Order expressly states that a separate backup or snapshot service is included. Snapshots, versioning, recycle bins, and retention are included only when listed in the plan. 11.4 Quotas and Performance You must remain within storage, inode, object, connection, protocol, and transfer limits. Performance may vary based on file size, access pattern, protocol, encryption, compression, network conditions, and shared-storage load. HYEHOST may limit abusive connection rates, operations, file counts, or I/O patterns that materially affect the platform or other users. 11.5 Data Integrity You are responsible for validating uploaded data, maintaining checksums where appropriate, and testing restoration. HYEHOST is not responsible for corruption that originated before upload or resulted from customer software, synchronization errors, malware, encryption, or accidental deletion. 12. Colocation 12.1 Service Order The colocation Service Order controls the rack space, power allocation, network ports, cross-connects, access rights, remote-hands allowance, term, and charges. 12.2 Customer Equipment You retain ownership of customer-supplied equipment and are responsible for its suitability, licensing, maintenance, insurance, and data. HYEHOST is not an insurer of customer equipment. Equipment must be safe, properly labeled, compatible with the agreed rack and power specification, and free from hazardous, leaking, damaged, or prohibited components. 12.3 Power and Network Limits You must not exceed the contracted power draw, circuit limit, rack allocation, cooling limit, or network port specification. HYEHOST may power down or disconnect equipment that creates an immediate safety, electrical, thermal, security, or network risk. Power, cross-connect, address, transit, and remote-hands overages may be billed at the current rate or the rate in the Service Order. 12.4 Access and Remote Hands Physical access is subject to data-center rules, identity checks, advance notice, escort requirements, security procedures, and site availability. HYEHOST may refuse access where an invoice is overdue, an account is suspended, verification is incomplete, or access would create a safety or security risk. Remote-hands work outside the included allowance is chargeable and may require prepayment. 12.5 Removal and Abandoned Equipment You must arrange removal of customer-owned equipment within 30 days after the colocation Service ends, unless the Service Order states a shorter lawful period. HYEHOST may charge storage, handling, packing, shipping, remote-hands, and disposal costs after termination. Equipment not collected after notice and the applicable legal period may be treated as abandoned, returned at your cost, or disposed of to the extent permitted by law. HYEHOST may retain possession of equipment where permitted by law until undisputed charges connected with the colocation Service are paid. 13. IP Space, BGP, Transit, Tunnels, and DNS 13.1 No Ownership of HYEHOST Address Space IP addresses, prefixes, AS resources, route objects, reverse-DNS zones, and related number resources supplied by HYEHOST are licensed for use only while the relevant Service remains active and in good standing. They are not sold and do not become your property. HYEHOST may renumber, replace, withdraw, reroute, filter, or reclaim a supplied address or prefix where reasonably required by an RIR, upstream network, law, abuse event, security issue, technical change, contract end, or resource availability. 13.2 IP Reputation, Geolocation, and Third-Party Access HYEHOST does not guarantee: A particular IP reputation, geolocation, classification, or database entry; Removal from a blocklist or threat-intelligence list; Access to streaming, social-media, search, email, financial, gaming, or other third-party platforms; Acceptance of reverse DNS, WHOIS, geofeed, RPKI, or IRR changes by third parties; or Email delivery, inbox placement, or reputation. Refunds are not issued because a third party blocks, limits, misclassifies, or does not recognize an IP address or prefix. 13.3 Permanent Email-Port Blocks on HYEHOST IP Space Outbound email and SMTP ports, including ports 25, 465, 587, and 2525, are permanently blocked on: IP addresses and prefixes supplied from HYEHOST-controlled address space; IP addresses and prefixes originated in BGP by AS47272, AS26556, or another ASN controlled by HYEHOST; and Services where the applicable Service Order states that email ports are blocked. These blocks will not be removed, temporarily lifted, bypassed, or excepted by request. Identity verification, account age, payment history, business status, or intended use does not create an exception. 13.4 Customer-Owned Prefix Exception HYEHOST does not apply its standard network-level email-port block to a customer-owned or lawfully controlled prefix where all of the following are true: The customer has provided satisfactory proof of ownership or authority; The prefix is originated in BGP by the customer's own ASN, not by a HYEHOST ASN; The prefix is announced to HYEHOST through an approved BGP session and is merely carried in transit by HYEHOST; and The Service Order does not impose a separate email restriction. This exception means only that HYEHOST does not apply the standard network-level port block. It does not permit spam, unsolicited bulk email, abusive mailing, bot-hosting mail, or any activity prohibited by these Terms. HYEHOST may filter or suspend a customer-owned prefix where email activity causes abuse reports, blocklisting, security risk, or breach of contract. 13.5 Authorization for Customer Prefixes By asking HYEHOST to announce, route, tunnel, sponsor, manage, or accept a customer-controlled prefix, you confirm that you have current authority from the lawful resource holder. You authorize HYEHOST to perform the routing, filtering, IRR, RPKI, geofeed, reverse-DNS, and network actions reasonably required to provide the ordered Service. This authorization ends when the relevant Service ends, unless a written transition period is agreed. 13.6 Routing Responsibilities You must not announce or cause: A prefix that you are not authorized to originate; A route leak, hijack, bogon, private prefix, invalid more-specific, or unauthorized default route; A route that exceeds an agreed maximum-prefix limit; A path, community, next hop, or attribute intended to mislead HYEHOST or another network; or Traffic with a spoofed or unauthorized source address. You must maintain accurate routing filters and promptly correct an invalid announcement. HYEHOST may reject, filter, dampen, blackhole, withdraw, or disable a route or BGP session without notice where needed to protect routing security or network stability. 13.7 IRR, RPKI, RIR, and Maintainer Requirements For HYEHOST-supplied IP space: Every client-created object relating to the space must include HYEHOST-MNT as the mnt-by attribute where supported; Records must be created, maintained, and controlled through the HYEHOST panel or another method approved in writing; Records created or changed outside the approved process may be removed, replaced, or corrected; HYEHOST does not add third-party maintainers to HYEHOST-controlled records; HYEHOST may create, replace, or remove IRR objects, ROAs, route permissions, assignments, and reverse-DNS delegations as required to supply or end the Service; and You must provide accurate end-user, assignment, abuse-contact, and routing information where required by an RIR, NIR, LIR, registry, upstream, or law. HYEHOST may suspend or terminate an IP Service that generates excessive reports from email providers, blocklists, public threat lists, AbuseIPDB, network operators, law enforcement, or similar sources. Failure to investigate, respond to, and mitigate abuse associated with allocated or routed IP space is a breach. 13.8 Unauthorized Announcements After Termination You must stop using and announcing HYEHOST-supplied IP space immediately when the relevant Service is suspended, terminated, or expires, unless HYEHOST grants a written transition period. Continuing to announce HYEHOST IP space after authorization ends is unauthorized and will be treated by HYEHOST as a prefix hijack. HYEHOST may revoke IRR and RPKI authorization, notify upstreams and registries, publish corrective routing information, and take legal or technical action to stop the announcement. 13.9 Transit, Tunnels, and Protection IP transit, BGP, and tunnel Services include only the capacity, routes, addresses, and protection stated in the Service Order. DDoS protection, scrubbing, full tables, default routes, communities, remote blackhole, BFD, or service credits are included only when expressly listed. HYEHOST may null-route, filter, rate-limit, or temporarily withdraw traffic that threatens the network, exceeds a technical limit, or affects other customers. 13.10 DNS and Reverse DNS DNS and reverse-DNS Services are provided on a reasonable-efforts basis. You are responsible for zone accuracy, DNSSEC keys under your control, record content, TTL choices, and timely updates. HYEHOST may refuse or remove a DNS or reverse-DNS record that is misleading, unlawful, abusive, technically invalid, or connected with spam, phishing, malware, or impersonation. 14. Support and Service Management 14.1 Support Response Target HYEHOST aims to respond to support tickets within six hours. This is a target, not a guaranteed response or resolution time, unless a written SLA expressly states otherwise. Complex technical issues, abuse investigations, billing disputes, hardware faults, RIR requests, upstream dependencies, and third-party matters may take longer. 14.2 Support Channels Technical, abuse, account, and billing matters must be submitted through a support ticket or another channel specifically approved by HYEHOST. Live chat is intended for pre-sales questions unless HYEHOST states otherwise. Social media, review websites, personal messages, and informal chat are not guaranteed support channels. 14.3 Ticket Conduct Tickets are generally handled based on the time of the most recent customer reply. Repeatedly bumping, reopening, duplicating, or replying to a ticket may move it later in the queue and delay handling. Spamming, threatening, or abusing the ticket system may result in support restrictions, suspension, or termination. 14.4 Unmanaged Services Unless expressly stated otherwise, Services are unmanaged. Support for an unmanaged Service generally covers access to the purchased infrastructure and reasonable investigation of faults within HYEHOST-controlled systems. Unmanaged support does not include ongoing system administration, software installation, application debugging, website repair, code changes, firewall design, data recovery, migration, security hardening, or third-party software support. 14.5 Managed Services A managed Service includes only the management tasks, systems, hours, response targets, and exclusions identified in the Service Order. Work outside that scope may be refused, quoted separately, or charged at the current rate. A managed designation does not transfer responsibility for Customer Content, application suitability, legal compliance, licensing, business continuity, or independent backups unless the Service Order expressly says otherwise. 14.6 Abusive Conduct Toward Staff HYEHOST expects respectful communication. Threats, harassment, discriminatory remarks, targeted profanity, intimidation, doxxing, repeated personal abuse, or attempts to coerce staff are prohibited. Serious or repeated abuse may result in immediate suspension or termination without refund. For less serious conduct, HYEHOST may provide up to five days' notice before restricting support or terminating the account. If HYEHOST chooses to issue a refund after a termination under this subsection, the refund is limited to the unused prepaid portion of the affected Service and excludes nonrecoverable charges. 15. Billing, Payment, Taxes, and Automatic Renewal 15.1 Payment Obligations You agree to pay all charges connected with your account and Services, including recurring charges, usage charges, overages, taxes, setup fees, remote-hands charges, restore charges, and other amounts shown in a Service Order or invoice. Unless another billing cycle is stated, payment is due in full on the monthly anniversary date of the Service. 15.2 Currency, Conversion, and Fees Prices are charged in the currency shown at checkout or on the invoice. You are responsible for card-conversion fees, bank fees, intermediary fees, blockchain fees, and other charges imposed by a payment provider. HYEHOST is not responsible for a difference caused by exchange rates or the settlement currency used by your bank or payment processor. 15.3 Taxes Prices exclude taxes unless stated otherwise. You are responsible for applicable sales, use, value-added, withholding, digital-services, or similar taxes, except taxes based on HYEHOST's net income. If a withholding is legally required, you must pay any additional amount needed so that HYEHOST receives the invoiced amount, except where applicable law prohibits this. 15.4 Payment Authorization By adding a card or another reusable payment method, enabling automatic payment, or accepting a recurring order, you authorize HYEHOST and its payment processors to charge that method for: The initial order; Recurring Service renewals; Approved upgrades and add-ons; Usage and overage charges; and Other charges that you authorize through the account. This authorization continues until the payment method is removed, automatic payment is disabled where available, or the relevant Services are canceled in accordance with these Terms. 15.5 Third-Party Billing Agreements A recurring payment profile created through PayPal or another third-party payment provider is controlled separately from the HYEHOST client area. Canceling a HYEHOST Service does not automatically cancel a third-party subscription or billing agreement. You must cancel that agreement directly with the provider. HYEHOST is not responsible for an unintended payment caused by your failure to cancel the third-party agreement. 15.6 Invoice Generation Renewal invoices may be generated up to 14 days before the Service renewal date. 15.7 Advance Payment Capture To reduce the risk of interruption and reserve capacity for the next term, HYEHOST may attempt to collect a renewal payment when the renewal invoice is generated. Additional attempts may be made before or after the due date. By keeping an automatic payment method on file, you agree that the renewal charge may be collected before the new Service period begins. 15.8 Cancellation Deadline and Early Billing A cancellation intended to prevent the next renewal charge must be submitted before the renewal invoice is generated and must also satisfy the minimum notice period in Section 19.4. Because an invoice may be generated up to 14 days before the due date, submitting a cancellation only five days before the due date may be too late to prevent a payment if the invoice has already been generated and charged. Once a renewal payment is captured, the Service is renewed for the next billing term and the payment is non-refundable, except where applicable law requires otherwise. 15.9 Payment Notices HYEHOST may send invoice, payment, overdue, and suspension notices to the account email address. Payment reminders may be sent on days one, three, and five after payment should have been made. You are responsible for ensuring that the account email address works and that HYEHOST messages are not blocked or filtered. Failure to receive a reminder does not remove the payment obligation or delay suspension. 15.10 Price Changes HYEHOST may change recurring prices for a future billing term. Where required by law or a signed agreement, HYEHOST will provide advance notice. Continuing a Service into the next term after the price change takes effect constitutes acceptance of the new price. A price change does not create a right to refund a term that was already accepted and paid. 15.11 No Set-Off Unless applicable law provides otherwise, you must not withhold, deduct, or set off an amount owed to HYEHOST because of a separate claim or dispute. 16. Non-Payment, Suspension, and Resource Reclamation 16.1 General Rights HYEHOST may suspend access, stop a Service, disable network connectivity, withdraw routes, power down hardware, or reclaim resources when an invoice is overdue, a charge is rejected, a payment method fails, or an account has another credit problem. Suspension does not cancel the amount owed and does not extend the billing term. 16.2 Web Hosting Plans For web, shared, WordPress, reseller, and similar hosting plans: Failure to pay for five consecutive days, including the anniversary date, may result in suspension; Failure to pay within seven consecutive days may result in termination and reclamation of the Service; and Customer data remaining after 14 days of non-payment may be permanently destroyed for security and privacy reasons. 16.3 VPS and Virtualized Services For VPS, VDS, and similar virtualized Services: An unpaid invoice is marked overdue at 9:00 a.m. UTC on the day after the due date; The Service may be suspended when the invoice is marked overdue or after up to three consecutive days of non-payment; and Failure to pay within five consecutive days may result in termination, deletion, and reclamation of the Service and its resources. 16.4 Dedicated Servers A dedicated server may be powered off when its invoice is marked overdue and may be terminated 72 hours later if payment has not been received. Once terminated, the hardware may be reassigned and the disks may be erased within hours. Reinstatement is not guaranteed. 16.5 Network, IP, Storage, and Colocation Services HYEHOST may withdraw routes, disable BGP, reclaim IP space, stop tunnels, restrict DNS, disable storage access, disconnect colocation equipment, or withhold physical access when an associated invoice is overdue. Service-specific termination and equipment-removal rules continue to apply. 16.6 Notices Overdue notices may be sent when a Service is suspended and again 24 and 48 hours after an invoice is marked overdue. HYEHOST is not required to send every notice before exercising a right stated in this section. 16.7 Data During Suspension HYEHOST does not guarantee access to Customer Content during suspension. You must not rely on a suspension period as a data-retrieval period. 17. Account Credit, Prepaid Services, and Affiliate Program 17.1 Account Credit Account credit is non-cash Service credit and: Cannot be withdrawn, sold, transferred, or redeemed through PayPal, bank transfer, cryptocurrency, card refund, or another payment method; May be restricted to specific Services or invoices; May be removed where it resulted from fraud, error, chargeback, affiliate abuse, duplicate compensation, or breach; and Is subject to the expiry rules below, except where applicable law prohibits expiry. On January 1 each year, 50% of the total account-credit balance expires. The minimum amount that expires is $25 until the balance reaches $0. If the remaining balance is less than $25, the entire remaining balance is removed. To request preservation of account credit, you must submit a support ticket during January. Approval is at HYEHOST's discretion unless applicable law requires otherwise. 17.2 Advance Payments and Prepaid Packages Advance payments and prepaid packages are eligible for refund within 24 hours of purchase only where they are not dedicated servers, custom orders, or another non-refundable item listed in Section 19. After the first 24 hours, advance payments and prepaid packages are non-refundable unless HYEHOST agrees otherwise in writing or applicable law requires a refund. 17.3 Affiliate Payouts Affiliate withdrawals are issued only as HYEHOST account credit. Affiliate earnings are not paid through PayPal, cryptocurrency, bank transfer, or another monetary processor. 17.4 Affiliate Restrictions Unless HYEHOST gives prior written approval: The affiliate system must not be used on coupon, discount, incentive, review, cashback, or promotional websites; Affiliate links must remain visible and must not be hidden, masked, framed, or placed behind a URL shortener; Self-referrals, related-party orders, duplicate accounts, misleading promotions, cookie stuffing, forced clicks, paid-to-click traffic, and false claims are prohibited; and An affiliate must clearly disclose its relationship with HYEHOST where required by law. Certain products, including some dedicated-server, network, and custom products, may not qualify for commission. 17.5 Affiliate Enforcement HYEHOST may withhold, reverse, or cancel affiliate earnings where fraud, refund, chargeback, self-referral, policy breach, or invalid traffic is suspected or confirmed. Affiliate abuse may result in account closure and cancellation of all unpaid earnings. 18. Chargebacks and Fraud Prevention 18.1 Contact HYEHOST First You must make a reasonable attempt to resolve a billing issue with the HYEHOST billing team before initiating a chargeback, payment reversal, or payment dispute, unless immediate action is reasonably required to protect you from an unauthorized transaction. 18.2 Evidence and Disclosure If a chargeback or payment dispute is filed, HYEHOST may dispute it and provide relevant evidence to the payment processor, bank, card issuer, fraud-prevention provider, arbitration provider, or other dispute handler. Evidence may include legal name, account details, billing information, payment records, acceptance records, Service usage, login records, IP addresses, support tickets, invoices, and order details. 18.3 Suspension During a Payment Dispute HYEHOST may suspend or restrict all Services associated with an account while a chargeback or payment dispute is pending, because the payment supporting those Services is contested. 18.4 Unwarranted or Fraudulent Chargebacks Where a chargeback is initiated without prior reasonable communication, under false pretenses, for a knowingly authorized charge, or as an attempt to retain a Service without payment, HYEHOST may: Immediately suspend or terminate all active Services on the account; Refuse future service; Apply a $35.00 administrative fee per chargeback to cover investigation and response work; Recover processor fees and other direct costs where permitted by law; and Report relevant details to an appropriate fraud-prevention database, including FraudRecord, where the report is accurate, lawful, and reasonably necessary. Termination following an unwarranted or fraudulent chargeback does not create a right to a refund for unused Service time. 18.5 Legitimate Rights Preserved Nothing in this section removes a legal right that cannot be waived. HYEHOST will handle payment-dispute information in accordance with its Privacy Policy and applicable law. 19. Refunds, Cancellations, and Reinstatement 19.1 24-Hour Money-Back Period HYEHOST offers a 24-hour refund period beginning when an eligible initial order is placed. The refund period applies only to the first eligible purchase of the relevant Service and is subject to this section. 19.2 Non-Refundable Items The following are non-refundable unless HYEHOST expressly agrees otherwise in writing or applicable law requires a refund: Add-ons; Dedicated servers and bare metal Services; Colocation setup, cross-connect, remote-hands, shipping, and installation charges; Custom orders and nonrecoverable purchases or commitments; Manually provisioned Services, including IP leasing and non-automatically provisioned VPS products; IP address space and network resources; IP space purchased on the assumption that third-party maintainer access will be provided, unless HYEHOST granted a written exception before purchase; Domain, license, certificate, registry, RIR, and third-party charges; Services for which a backup restore, migration, custom engineering task, or data recovery attempt has been processed; Cryptocurrency payments; Upgrade orders; Usage, overage, bandwidth, remote-hands, and abuse-intervention charges; Setup and activation charges; and Any item identified as non-refundable in the Service Order. 19.3 Refund Exclusions After 24 Hours After the first 24 hours, refunds are not issued for: Downtime or data loss caused by the User, Customer Content, customer software, or customer configuration; A Service that is no longer wanted or needed; Failure to read the plan description or these Terms; Incompatibility that the User was responsible for checking; Dissatisfaction with the support level of an unmanaged Service; IP reputation, geolocation, classification, blocklisting, or third-party access restrictions; Suspension or termination caused by a breach, abuse, fraud, chargeback, or non-payment; or An event excluded from an applicable SLA. 19.4 Voluntary Cancellation and Notice Period You may request cancellation through the HYEHOST client area. Month-to-month Services require at least five days' notice before the anniversary billing date for cancellation or downgrade. To prevent automatic payment, the request must also be submitted before the renewal invoice is generated, as explained in Section 15.8. 19.5 Renewal Payments Renewal payments are non-refundable once captured. You are responsible for canceling before invoice generation and the applicable notice deadline. 19.6 Third-Party Subscriptions A cancellation in the HYEHOST client area does not cancel a PayPal subscription or another third-party recurring payment agreement. You must cancel it separately with the payment provider. HYEHOST will not refund an automated third-party payment caused by your failure to cancel the corresponding third-party agreement. 19.7 No Proration HYEHOST does not provide prorated refunds for voluntary cancellation, downgrade, unused resources, or early departure from a prepaid term. 19.8 Refund Method An approved refund will normally be returned to the original payment method where possible. HYEHOST may issue account credit where the original method cannot accept a refund, the payment processor requires it, or the User agrees. Transaction charges, blockchain fees, conversion differences, and nonrecoverable payment fees may be excluded where permitted by law. 19.9 Reinstatement VPS and dedicated servers: Once terminated, these Services generally cannot be reinstated. Data and disks may be erased within hours. Web hosting: A terminated hosting plan cannot normally be reinstated. A new plan must be purchased. Network and IP Services: A reclaimed prefix, BGP session, tunnel, route object, ASN resource, or IP address may have been reassigned and is not guaranteed to be available again. Storage Services: Deleted storage data is not guaranteed to be recoverable. 19.10 HYEHOST Termination for Convenience If HYEHOST terminates a paid Service for convenience and not because of breach, non-payment, fraud, abuse, legal requirement, security risk, or third-party withdrawal, HYEHOST may provide a prorated refund or account credit for the unused prepaid period. Nonrecoverable costs remain excluded. 19.11 Statutory Consumer Cancellation Rights The voluntary refund policy and non-refundable classifications in this section do not exclude mandatory consumer rights. If you contract as a consumer and an applicable distance-selling law provides a cooling-off period, you may cancel within that period. For UK service contracts this is normally 14 days beginning the day after the contract is made. Longer periods may apply where legally required information has not been supplied. Accepting these Terms, paying, provisioning, allocating an IP address, or describing a Service as intangible does not by itself waive that right. To exercise a statutory cancellation right, send a clear statement through a support ticket in the client area or to support@hyehost.org identifying your account and order and stating that you wish to cancel. You do not need to use a particular form or give a reason. Sending the statement before the applicable deadline is sufficient. The normal five-day notice requirement, invoice-generation deadline and no-proration policy do not restrict this statutory right. Where a statutory refund is due, we will make it within the legally required period, normally no later than 14 days after being informed of cancellation, using the original payment method unless you expressly agree otherwise. We will not impose a cancellation fee or payment-processing deduction where prohibited by law. Model cancellation form (use is optional): To HYEHOST LLC, support@hyehost.org / the HYEHOST support portal. I/We give notice that I/We cancel the contract for the following Service: [service/order reference]. Ordered on: [date]. Consumer name: [name]. Consumer address: [address]. Date: [date]. Signature only if sent on paper. 19.12 Express Request to Begin Services During the Cooling-Off Period For immediate supply, we will ask separately for your express request to start the ordered Service before an applicable cooling-off period ends. This request must be an affirmative action; it is not inferred from accepting these Terms or from a preselected checkbox. If you do not want early supply, contact support before ordering to arrange a later start. If you exercise a statutory right to cancel after making that request, you may be required to pay a lawful proportion of the agreed price for the Service actually supplied up to the time you communicate cancellation. This is not automatically the full term price or an activation charge. Any amount retained must satisfy applicable law, including its information and express-request requirements. For UK service contracts, the cancellation right is lost only once the contracted Service has been fully performed after your express request and your acknowledgment of that consequence. Provisioning alone does not fully perform an ongoing hosting, tunnel, transit or IP lease contract. Other statutory remedies for faulty or misdescribed services remain available. We retain a dated record of the separate request and the terms version presented, and provide a copy of that request and the applicable terms in a form you can save. These consent requirements apply prospectively; no consent is inferred or backdated for an earlier order. 19.13 Digital Content A different statutory rule may apply to genuinely downloadable or streamed digital content. Where we rely on that rule, we must obtain your separate express consent to immediate supply and your acknowledgment that the applicable cancellation right will be lost when supply begins, and provide the legally required confirmation. We do not treat an ongoing hosting, tunnel, transit or IP lease Service as digital content merely because it is delivered electronically. 20. Acceptable Use Policy and Abuse Prevention 20.1 General Requirement You must use the Services lawfully, responsibly, and in a way that does not harm HYEHOST, its infrastructure, its suppliers, other users, third parties, or the reputation and deliverability of HYEHOST networks and IP resources. The examples below are not exhaustive. HYEHOST may act against materially similar abuse or any activity that creates a serious legal, security, operational, or reputational risk. 20.2 Illegal and Harmful Content or Activity You must not use a Service to host, store, transmit, facilitate, advertise, or support: Activity that violates an applicable law, regulation, sanctions rule, court order, or legally binding requirement; Child sexual abuse material, sexual exploitation of minors, grooming, or content that sexualizes minors; Human trafficking, terrorism, credible threats of violence, or instructions directly supporting a serious violent crime; Fraud, impersonation, identity theft, advance-fee fraud, payment fraud, or deceptive commercial activity; Phishing, credential theft, fake login pages, payment-card theft, or unauthorized collection of personal information; Malware, ransomware, spyware, keyloggers, botnets, command-and-control systems, malicious loaders, exploit kits, or software primarily intended to compromise systems; Stolen data, unlawfully obtained credentials, access tokens, payment details, or confidential information; Copyright, trademark, trade-secret, patent, privacy, publicity, or other rights infringement; Unlawful harassment, stalking, doxxing, threats, extortion, or defamation; Unlawful gambling or another regulated service operated without required authorization; or Material intended to evade law enforcement, sanctions, payment controls, or a valid court order. 20.3 Network and Security Abuse The following are prohibited: Denial-of-Service or Distributed Denial-of-Service attacks; Participation in amplification, reflection, stress testing, or attack-for-hire against a system you do not own or have written permission to test; Unauthorized access, intrusion, exploitation, credential stuffing, brute force, vulnerability scanning, port scanning, or probing of a third-party system; IP spoofing or falsifying packet, routing, DNS, email, or identity information to conceal or misrepresent origin; Route leaks, prefix hijacks, unauthorized announcements, or manipulation of BGP attributes; Operating a botnet, malware controller, phishing kit, malicious redirector, or attack infrastructure; Distributing software primarily intended to facilitate an unlawful attack or breach; and Circumventing HYEHOST security controls, resource limits, filters, suspensions, or network restrictions. Legitimate security testing is permitted only against systems you own or where you have clear written authorization, and only when it does not affect HYEHOST or third parties. 20.4 Adult Content Hardcore adult content and pornographic websites are prohibited on shared, free, and reseller hosting. Dedicated servers and other isolated Services may have different restrictions, but you must obtain written confirmation from HYEHOST before ordering or deploying adult content. Illegal sexual content is prohibited on every Service. 20.5 Email Ports, Spam, and Messaging Abuse The permanent network-level email-port restrictions in Section 13.3 apply to HYEHOST IP space and prefixes originated by a HYEHOST ASN. The customer-owned prefix exception in Section 13.4 does not reduce the following rules: Spam, unsolicited bulk email, purchased mailing lists, harvested addresses, snowshoe mailing, list washing, and abusive email are prohibited; You must not operate an open mail relay, send deceptive headers, forge sender identity, or evade provider limits; Email marketing must comply with all applicable consent, identification, unsubscribe, privacy, and recordkeeping laws; Repeated bounces, complaint rates, blocklisting, or abuse reports may result in filtering, suspension, or termination; Each confirmed email-abuse report may result in a $25 manual-intervention fee for investigation and remediation; and Free and paid bot hosting is subject to the complete no-mailing restriction in Section 10, regardless of the IP prefix used. 20.6 Proxies, VPNs, Tor, and Anonymization A private VPN or proxy on a general-purpose VPS is not automatically prohibited, provided that it is lawful, secured, not offered as an open public service, and does not generate abuse, blocklisting, attacks, or excessive complaints. The following are prohibited: Open public proxies; Tor exit, middle, or bridge relays that cause blocklisting or excessive downstream complaints; Anonymization, residential-proxy, traffic-resale, or exit services that conceal abuse or create repeated complaints; Services marketed or used primarily to evade platform bans, fraud controls, sanctions, or law enforcement; and Any proxy, VPN, tunnel, relay, or anonymization use on bot hosting under Section 10. 20.7 Financial Schemes The financial-scheme restrictions in Section 9.5 apply to every free and paid HYEHOST hosting Service, including web hosting, VPS, dedicated servers, storage, and bot hosting. No Service may be used to offer, operate, advertise, or promote an investment scheme, cryptocurrency scheme, high-yield program, guaranteed-return program, recovery scheme, or similar financial program that is unlicensed, misleading, suspicious, fraudulent, or unlawful. Confirmed violations may result in removal without warning and a permanent ban from HYEHOST. 20.8 Resource Abuse You must not: Exceed CPU, memory, storage, process, I/O, connection, or bandwidth limits; Run sustained activity designed mainly to consume shared resources rather than support a genuine workload; Deliberately pin a network port at full capacity to exhaust a transfer allowance as quickly as possible and then purchase further Services in bulk to repeat the pattern; Use free Services through duplicate accounts or automation to evade quotas; or Interfere with the stability, performance, or availability of another customer or HYEHOST system. 20.9 Copyright and Rights Complaints HYEHOST may remove or disable access to material that is alleged to infringe copyright or another legal right. HYEHOST may request a complete notice containing enough information to identify the work, the material, the complaining party, the legal basis, and a good-faith statement. Customers who repeatedly infringe copyright or other rights may be terminated. Copyright complaints should be submitted through the HYEHOST support portal or the designated-agent contact published by HYEHOST, if applicable. A false or abusive notice may be rejected and may expose the sender to liability. 20.10 Abuse Reports and Customer Response You must investigate and respond to an abuse notice within the deadline stated in the notice. HYEHOST may require removal, mitigation, logs, explanation, configuration changes, customer identification, or other reasonable corrective action. Failure to respond, an inadequate response, repeated reports, or continued harmful traffic may result in suspension or termination. 20.11 Enforcement HYEHOST may, with or without prior notice: Block traffic, ports, domains, files, processes, routes, or accounts; Null-route an IP address or prefix; Isolate, suspend, or terminate a Service; Remove or disable access to Customer Content; Preserve relevant logs or evidence; Require identity or customer verification; Charge an intervention fee stated in these Terms or a Service Order; Notify upstreams, registries, platforms, payment providers, rights holders, or affected parties where lawful and reasonably necessary; and Cooperate with courts, regulators, law enforcement, and emergency services. A suspected serious violation may result in immediate suspension while HYEHOST investigates. A confirmed violation may result in termination without notice or refund. Repeated or severe violations may result in permanent account termination. HYEHOST is not required to allow continued access to data or Services during an abuse investigation. 21. Network Usage and Fair-Use Policy 21.1 Shared Network Infrastructure All unmetered VPS and dedicated-server products use shared bandwidth ports unless the Service Order expressly states that the port or capacity is dedicated. This Fair-Use Policy protects network stability and reasonable access for all users. HYEHOST network identifiers include AS47272 and AS26556. 21.2 Unmetered-Port Guidelines For an unmetered port without a fixed monthly transfer allocation: Sustained usage of 100 Mbps, 24 hours a day, is always considered within fair use and will not be questioned; Bursts to the full advertised port speed are expected and permitted for normal transfers, deployments, backups, and temporary traffic spikes; Sustained usage above 100 Mbps is acceptable in most cases and will generally be reviewed only where it is clearly abusive or continuously affects shared infrastructure; and Total transfer exceeding 30 TB in a calendar month may be treated as outside normal fair use. Where usage exceeds the normal fair-use range, HYEHOST may reduce the port to 100 Mbps, contact you to discuss the workload, or require a plan with dedicated bandwidth. The 30 TB figure is a review point, not an automatically enforced hard cap. 21.3 Metered Plans A plan with a defined monthly transfer allowance, such as 10 TB or 25 TB, is not subject to the same sustained-rate guideline as an unmetered port. However, deliberately saturating the port solely to exhaust the allowance as quickly as possible, followed by purchasing additional Services in bulk to repeat the pattern, is abuse. Transfer allowances are intended for genuine workload traffic, not a system for maintaining maximum line rate indefinitely. 21.4 Prohibited Continuous Usage Continuously operating at or near 100% of port capacity for an extended period may be outside fair use where it affects shared infrastructure or other users. Examples include: A website, application, relay, or transfer system that continuously exhausts shared capacity; Continuous uploading, downloading, or file sharing without reasonable variation or interruption; and Activity designed primarily to consume bandwidth rather than support a genuine workload. 21.5 Monitoring and Corrective Action HYEHOST may monitor traffic volume, flow data, interface utilization, packet rates, and related network metrics to assess compliance. Where usage is excessive or abusive, HYEHOST may: Throttle the port to 100 Mbps or another appropriate speed; Apply packet-per-second, connection, protocol, or route limits; Temporarily suspend the Service; Require migration to a higher-tier or dedicated-bandwidth Service; or Work with you to adjust the usage pattern. 21.6 Severe Impact If traffic severely affects connectivity, stability, security, or Service quality for other users, HYEHOST may throttle, filter, null-route, suspend, or terminate the affected Service immediately and without prior notice. 21.7 Exceptions and Custom Arrangements A User with a legitimate requirement for consistent high-bandwidth use should obtain written approval or a dedicated-bandwidth Service. An exception is valid only when documented in a Service Order, signed agreement, or written approval from an authorized HYEHOST representative. 22. Availability, Maintenance, DDoS Events, and SLAs 22.1 No General Uptime Guarantee Unless a Service Order or separate SLA expressly states an uptime commitment, the Service has no guaranteed uptime, response time, repair time, packet-loss level, latency level, or restoration deadline. Support targets, status-page estimates, and general marketing statements are not SLAs. 22.2 Maintenance HYEHOST may perform scheduled and emergency maintenance. Scheduled maintenance may be announced where practical. Emergency maintenance may occur without notice where needed to protect security, data, hardware, routing, power, cooling, or network stability. Maintenance may involve reboots, migrations, temporary routing changes, service interruption, reduced redundancy, or restricted access. 22.3 DDoS and Network Protection HYEHOST may provide infrastructure protection, but customer Services are not guaranteed to withstand an attack unless the Service Order states a specific protection commitment. If a Service or IP address is attacked, HYEHOST may automatically filter, rate-limit, divert, or null-route the affected traffic. Repeated attacks, attacks exceeding available protection, or continuing risk to the network may result in extended null-routing, suspension, required mitigation changes, or termination. 22.4 SLA Credits Where a written SLA applies: The SLA document controls eligibility and calculation; A credit request must be submitted within seven days after the qualifying event unless the SLA states another period; HYEHOST may require logs, monitoring data, timestamps, and affected Service details; Account credit is the sole and exclusive remedy for SLA downtime unless the SLA expressly states otherwise; and Credits cannot exceed the recurring charge for the affected Service and period. 22.5 Common SLA Exclusions Unless the written SLA states otherwise, downtime does not qualify where caused by: Scheduled or emergency maintenance; Customer Content, customer configuration, customer software, credentials, firewall rules, or resource exhaustion; A DDoS attack or security event beyond the included protection; An upstream, carrier, RIR, registry, data-center, power, cross-connect, cloud, or third-party failure outside HYEHOST's reasonable control; Law enforcement, sanctions, a court order, abuse handling, or legal compliance; Suspension, non-payment, fraud review, chargeback, or breach; Force majeure under Section 33.1; or Monitoring failure where the Service itself remained available. 22.6 Status Information A status page, monitoring graph, looking glass, or support estimate is informational and may be delayed, incomplete, or revised as an incident is investigated. 23. Free, Trial, Promotional, Preview, and Beta Services 23.1 Provided Without Commitment Free, trial, promotional, preview, and beta Services are provided "as is" and "as available" without an uptime, backup, retention, support, capacity, feature, or continuation commitment unless expressly stated in the Service Order. 23.2 Changes and Reclamation HYEHOST may change limits, require periodic renewal, reclaim inactive resources, remove unsupported features, restrict locations, or discontinue such a Service at any time. Customer Content may be deleted immediately when a free or trial Service expires, becomes inactive, is not renewed, is found to be duplicated, or is terminated. 23.3 Fair Access You must not create multiple accounts, use false identities, automate signups, rotate payment details, or use related persons to obtain more free or promotional Services than permitted. HYEHOST may link related accounts for enforcement and may terminate all linked accounts where limits are evaded. 23.4 Promotions Promotional prices, credits, features, and discounts apply only for the period and eligibility stated. They do not create a right to the same price or feature at renewal. 24. Privacy, Monitoring, and Legal Requests 24.1 Privacy Policy HYEHOST processes account and Service information in accordance with the HYEHOST Privacy Policy and applicable law. You are responsible for reviewing that policy and for providing any privacy notice or obtaining any consent required from your customers, staff, users, and data subjects. 24.2 Operational Monitoring HYEHOST may collect and review information reasonably needed to operate, secure, bill, troubleshoot, and protect the Services, including: Account, payment, login, and authentication records; Resource utilization, flow data, packet metadata, routing information, and system logs; Abuse reports, malware indicators, blocklist data, and security alerts; Support communications and administrative actions; and Customer Content where access is reasonably necessary to investigate a fault, respond to an abuse report, comply with law, protect a person or system, or carry out an authorized support request. HYEHOST is not required to monitor all Customer Content and does not assume responsibility for content merely because it has the technical ability to access or remove it. 24.3 Legal and Emergency Requests HYEHOST may preserve or disclose information where it reasonably believes disclosure is required or permitted by law, a valid legal process, a court order, sanctions compliance, fraud prevention, an emergency involving risk of death or serious injury, or protection of HYEHOST and third-party rights. HYEHOST may challenge, narrow, or reject a request where appropriate, but is not required to do so. 24.4 Data Processing Agreements A Data Processing Agreement or special security commitment applies only when accepted in writing by an authorized HYEHOST representative. The general availability of a template or policy does not by itself create a signed DPA or special compliance obligation. 24.5 Data Location Unless a Service Order guarantees a specific location, account records, support data, logs, backups, and operational information may be processed in the United States or another country where HYEHOST or its suppliers operate, subject to applicable law and the Privacy Policy. 25. Intellectual Property and Third-Party Services 25.1 HYEHOST Property HYEHOST websites, branding, logos, control panels, automation, documentation, templates, software, designs, text, and other materials supplied by HYEHOST remain the property of HYEHOST or its licensors. Except as required to use the purchased Service, you receive no ownership or license to copy, resell, reverse engineer, scrape, reproduce, or create derivative works from HYEHOST materials. 25.2 Customer Content HYEHOST does not claim ownership of Customer Content. Your use of Customer Content remains subject to Section 5 and applicable law. 25.3 Feedback If you voluntarily provide a suggestion, feature request, or technical idea, you permit HYEHOST to use it without payment or restriction. This does not transfer ownership of your confidential information or Customer Content. 25.4 Third-Party Software and Services A Service may depend on third-party software, licenses, payment processors, data centers, networks, registries, operating-system vendors, control panels, APIs, or cloud services. Third-party terms may apply. HYEHOST is not responsible for a third party changing, suspending, withdrawing, blocking, or ending its product or service. Where a third-party change materially prevents continued supply, HYEHOST may replace the component, change the Service, migrate the workload, or terminate the affected Service under Section 3.2. 25.5 Open-Source Software Open-source software remains subject to its applicable license. Nothing in these Terms limits rights granted directly by an open-source license. 26. Complaints and Public Feedback 26.1 Complaints Process HYEHOST encourages customers to submit concerns through the HYEHOST Suggestions and Complaints Department or support system before publishing public feedback. This gives HYEHOST an opportunity to investigate and attempt to resolve the issue. 26.2 Honest Reviews Nothing in these Terms prevents or penalizes an honest review, including an honest negative review, or a lawful report to a regulator, law-enforcement body, payment provider, court, or consumer-protection organization. HYEHOST will not terminate an account, remove privacy protections, or impose a fee solely because a customer publishes an honest opinion about HYEHOST, its Services, or its support. 26.3 Unlawful or Improper Content HYEHOST may report, challenge, or seek removal of public content that: Discloses confidential, private, financial, medical, personnel, security, or trade-secret information without authorization; Is defamatory, threatening, harassing, abusive, discriminatory, obscene, or otherwise unlawful; Is clearly false, fraudulent, or materially misleading; Impersonates HYEHOST, a customer, an employee, or another person; Is posted as part of extortion, coercion, fraud, review manipulation, or coordinated abuse; or Includes credentials, private keys, access tokens, internal security details, or information that creates a security risk. A customer may still be suspended or terminated for a separate breach of these Terms, even where the customer has also published feedback. Publishing feedback does not waive or cancel the Privacy Policy, a lawful confidentiality obligation, or another legal right held by either party. 27. Suspension, Termination, and Effect of Termination 27.1 Grounds for Action HYEHOST may restrict, suspend, or terminate a Service or account where reasonably necessary because of: Non-payment, rejected payment, or chargeback; Fraud, false information, failed verification, or sanctions risk; A breach of these Terms, a Service Order, or applicable law; Abuse, security risk, network instability, or harm to another user; A valid legal, regulatory, registry, data-center, or upstream requirement; Loss of a required third-party resource or authorization; Repeated support abuse or refusal to cooperate with an investigation; or A serious risk to HYEHOST, its staff, infrastructure, reputation, or suppliers. 27.2 Immediate Action HYEHOST may act without prior notice where the issue involves active abuse, fraud, malware, phishing, child sexual abuse material, a network attack, route hijack, compromised systems, sanctions, legal compulsion, danger to persons, or a serious threat to infrastructure. For lower-risk issues, HYEHOST may provide a correction deadline, but is not required to do so where delay would increase risk. 27.3 Account-Wide Enforcement Where accounts, Services, payment details, identities, companies, operators, or technical resources are reasonably linked, HYEHOST may apply enforcement across the linked accounts and Services to prevent evasion or continued abuse. 27.4 Access and Data Suspension or termination may immediately remove console, control-panel, network, routing, physical, and data access. HYEHOST is not required to provide a data-retrieval period after termination. Data handling is governed by Section 6 and the service-specific termination timelines. 27.5 Amounts Owed Termination does not cancel charges that accrued before termination. You remain responsible for unpaid invoices, overages, intervention fees, third-party costs, equipment-removal costs, and other valid amounts. 27.6 Continuing Obligations Sections that by their nature should continue after termination remain effective, including payment obligations, intellectual-property terms, confidentiality obligations, disclaimers, liability limits, indemnification, dispute resolution, and general provisions. 28. Warranty Disclaimers 28.1 As-Is and As-Available Service To the maximum extent permitted by law, the Services are provided "as is" and "as available." HYEHOST disclaims all express, implied, and statutory warranties not expressly stated in a Service Order, including warranties of merchantability, fitness for a particular purpose, satisfactory quality, title, non-infringement, uninterrupted operation, error-free operation, security, compatibility, and data preservation. 28.2 No Guarantee of Results HYEHOST does not warrant that: A Service will meet every requirement or intended use; Customer Content will never be lost, corrupted, accessed, or altered; A backup or restore will succeed; A security control will stop every attack; A DDoS mitigation system will absorb every attack; Software, hardware, storage, routing, or third-party services will be free from defects; An IP address will have a particular reputation, geolocation, deliverability, or third-party accessibility; or Support will resolve an issue within a particular time unless a written SLA expressly says so. 28.3 Statutory Rights Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions apply only to the maximum extent permitted, and non-waivable statutory rights remain unaffected. 29. Limitation of Liability 29.1 Excluded Damages To the maximum extent permitted by law, HYEHOST and its owners, managers, employees, contractors, affiliates, suppliers, and licensors are not liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage. This exclusion includes loss of: Data, backups, files, configurations, or Customer Content; Profit, revenue, sales, business, opportunity, contracts, or anticipated savings; Goodwill, reputation, IP reputation, search ranking, email deliverability, or third-party access; Use of a Service, software, hardware, address, prefix, route, domain, or account; and Time or cost spent recreating data, migrating, investigating, or obtaining a replacement service. 29.2 Liability Cap To the maximum extent permitted by law, HYEHOST's total aggregate liability arising from or relating to a Service, these Terms, or a Service Order will not exceed the total recurring Service fees actually paid to HYEHOST for the directly affected Service during the three months immediately before the event giving rise to the claim. For a free Service, HYEHOST's aggregate liability is limited to the minimum amount required by applicable law, if any. The cap applies across all claims, events, legal theories, and parties and is not increased by multiple incidents or claimants. 29.3 Basis of the Bargain The warranty disclaimers, damage exclusions, and liability cap are material parts of the pricing and allocation of risk between the parties. They apply even if a remedy fails of its essential purpose and even if HYEHOST was advised that a loss was possible. 29.4 Exclusions Required by Law Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or another matter to the extent applicable law prohibits limitation. 29.5 Claims Against Suppliers and Personnel You agree that HYEHOST's affiliates, personnel, suppliers, data centers, upstreams, licensors, and contractors may rely on the protections in this section to the extent a claim relates to the Services. 30. Indemnification 30.1 Customer Indemnity To the maximum extent permitted by law, you will defend, indemnify, and hold harmless HYEHOST and its owners, managers, employees, contractors, affiliates, suppliers, data centers, upstreams, and licensors from third-party claims, liabilities, losses, penalties, judgments, damages, and reasonable legal costs arising from or relating to: Customer Content; Your use or misuse of the Services; Activity by your employees, contractors, customers, resellers, or end users; A breach of these Terms, a Service Order, or applicable law; Infringement or alleged infringement of intellectual-property, privacy, publicity, confidentiality, or other rights; Fraud, spam, phishing, malware, network attacks, abusive routing, or unauthorized announcements; A tax, license, consent, or regulatory obligation that is your responsibility; or Damage to HYEHOST, a data center, a network, or third-party property caused by customer-owned equipment or activity. 30.2 Indemnity Process HYEHOST will provide reasonable notice of an indemnified claim where legally permitted. You may control the defense using competent counsel, but you must not settle a claim in a way that admits fault by HYEHOST, imposes an obligation on HYEHOST, or restricts HYEHOST without HYEHOST's written consent. HYEHOST may participate in the defense with counsel of its choice at its own cost, except where your failure to defend makes additional costs reasonably necessary. 30.3 Consumer Limitation This section applies to a consumer only to the extent permitted by applicable consumer-protection law. 31. Dispute Resolution and Binding Arbitration 31.1 Required Notice THIS CONTRACT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES. Please read this section carefully. Arbitration is a private dispute-resolution process. It generally replaces a court trial and limits appeal rights. Except for the exclusions below, you and HYEHOST agree to resolve disputes individually rather than through a judge, jury, class action, collective action, or representative action. 31.2 Informal Resolution Before Filing Before filing arbitration or a court claim, the complaining party must send a written "Notice of Dispute" and allow 30 calendar days for informal resolution. A Notice of Dispute sent by you must be submitted through a support ticket or emailed to support@hyehost.org with the subject "Notice of Dispute." It must include: Your full legal name and account email address; The affected Service and invoice or order number, where applicable; A clear description of the facts and legal basis of the dispute; The amount or other relief requested; and A statement that the notice is submitted under Section 31.2. HYEHOST may send its Notice of Dispute to the email address registered on the account. The parties will use reasonable efforts to resolve the dispute during the 30-day period. A filing made before this process is completed may be dismissed or paused, and the filing party may be responsible for avoidable fees where permitted by law. 31.3 Agreement to Arbitrate Except for a dispute excluded by Section 31.5, you and HYEHOST agree that every claim or dispute arising out of or relating to: These Terms or a Service Order; The formation, acceptance, interpretation, performance, breach, or termination of the agreement; An account, order, invoice, payment, refund, chargeback, suspension, or termination; A Service, Customer Content, network event, data loss, security incident, support interaction, or public statement; or A relationship between you and HYEHOST, will be resolved by final and binding individual arbitration. The Federal Arbitration Act, 9 U.S.C. Sections 1 through 16 ("FAA"), governs the interpretation and enforcement of this arbitration agreement because the Services involve interstate and international commerce. 31.4 Non-Waivable Rights Nothing in this section removes a consumer right, regulator complaint right, public-injunctive-relief right, or access to a court that cannot lawfully be waived in the User's jurisdiction. 31.5 Disputes That May Be Brought in Court Either party may: Bring an eligible individual claim in small claims court; Seek temporary or preliminary injunctive relief in court to prevent an active or imminent security breach, unauthorized access, route hijack, intellectual-property infringement, misuse of confidential information, or other harm that cannot reasonably wait for arbitration; Report a matter to law enforcement, a regulator, an RIR, a registry, a payment provider, or another competent authority; and Ask a court to determine whether an arbitration agreement was formed, whether a party validly opted out, or whether the class-action waiver in Section 31.10 is enforceable. Seeking temporary relief does not waive arbitration of the underlying claim. 31.6 Arbitration Administrator and Rules Arbitration will be administered by the American Arbitration Association ("AAA"): Under the AAA Consumer Arbitration Rules where the User is an individual who obtained the Service primarily for personal, family, or household use; or Under the AAA Commercial Arbitration Rules for business, professional, reseller, network, colocation, and other non-consumer disputes. For an international non-consumer dispute, the AAA may administer the matter through its International Centre for Dispute Resolution under the applicable international rules. The rules in effect when the arbitration is filed apply, except where they conflict with a non-waivable part of this section. If the AAA is unavailable or declines to administer the dispute, the parties will attempt to agree on a comparable neutral provider. If they cannot agree, a court with jurisdiction may appoint an arbitrator or provider under the FAA. 31.7 Arbitrator and Authority The arbitration will be decided by one neutral arbitrator unless the applicable rules require otherwise. The arbitrator may award any individual remedy that a court could award under applicable law, including damages, declaratory relief, and injunctive relief, but only for the individual claimant and only to the extent needed to resolve that claimant's case. The arbitrator will issue a written, reasoned decision unless the parties agree otherwise. Except for matters reserved to a court in Section 31.5, the arbitrator decides disputes about the interpretation, scope, applicability, and enforceability of this section. 31.8 Hearing Format and Location The arbitration may proceed through documents, telephone, video conference, or an in-person hearing, as permitted by the applicable rules and determined by the arbitrator. For a consumer, an in-person hearing will take place in the county where the consumer lives or another mutually agreed location, unless the applicable rules provide a more convenient option. For a non-consumer, an in-person hearing will take place in Missouri or another location agreed by the parties. Remote participation may be used to reduce cost and travel. 31.9 Fees and Legal Costs For a consumer arbitration, the consumer will not be required to pay more than the consumer filing amount allowed by the AAA Consumer Arbitration Rules, and HYEHOST will pay fees that the applicable rules require the business to pay. For a non-consumer arbitration, fees are allocated under the AAA Commercial Arbitration Rules and the arbitrator's award. Each party is responsible for its own legal fees and expenses unless a statute, the applicable rules, or the arbitrator's award permits recovery. An arbitrator may award fees or costs against a party that brings a frivolous, bad-faith, or improperly filed claim where permitted by law and the applicable rules. 31.10 Individual Proceedings and Class Action Waiver TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND HYEHOST AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine claims or preside over a representative proceeding without the written consent of every affected party. If a court finally determines that this waiver is unenforceable for a particular claim or form of relief, that claim or relief will proceed in court, and any arbitrable claims will proceed in arbitration to the extent practical. 31.11 Jury Trial Waiver For any dispute that lawfully proceeds in court rather than arbitration, you and HYEHOST waive trial by jury to the maximum extent permitted by law. 31.12 Right to Opt Out of Arbitration You may opt out of Sections 31.3 through 31.11 by sending written notice within 30 calendar days after you first accept this version of the Terms. The opt-out notice must be submitted through a support ticket or emailed to support@hyehost.org with the subject "Arbitration Opt-Out" and must include: Your full legal name; Your HYEHOST account email address; Your company name, if the account is held by a company; A clear statement that you opt out of the arbitration agreement in Section 31; and The date of the notice. An opt-out applies only to the person or entity identified in the notice. Opting out will not affect your ability to use the Services and will not change any other part of these Terms. 31.13 Time Limit for Claims To the maximum extent permitted by law, a claim arising from these Terms or the Services must be filed within one year after the claim accrued. A claim filed after that period is permanently barred. This one-year period does not apply where applicable law requires a longer non-waivable period, or to HYEHOST's collection of an unpaid undisputed invoice within the period allowed by law. 31.14 Survival and Severability This arbitration agreement survives account closure, payment, cancellation, and termination. If a part of this section is unenforceable, it will be severed or limited to the minimum extent necessary, and the remainder will continue, except as specifically stated in Section 31.10. 32. Governing Law and Court Venue 32.1 Governing Law These Terms and each Service Order are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, except that the FAA governs Section 31. 32.2 Court Venue Where a dispute is not subject to arbitration and may lawfully be brought in court, the parties consent to the exclusive jurisdiction of the state and federal courts located in Missouri, except where a consumer has a non-waivable right to bring a claim in another location. 32.3 Equitable Relief Nothing prevents either party from seeking lawful temporary relief in a court with jurisdiction as permitted by Section 31.5. 33. General Provisions 33.1 Force Majeure HYEHOST is not liable for delay or failure caused by an event beyond its reasonable control, including natural disaster, severe weather, fire, flood, epidemic, war, terrorism, civil disorder, labor dispute, government action, sanctions, utility failure, power-grid failure, cable cut, data-center event, upstream outage, Internet-wide routing event, major DDoS attack, emergency maintenance, supplier failure, or failure of a registry, RIR, payment network, or telecommunications provider. HYEHOST will use reasonable efforts to reduce the effect of the event and resume affected Services where practical. 33.2 Assignment You may not assign or transfer these Terms, an account, or a Service without HYEHOST's prior written consent. HYEHOST may assign these Terms or a Service Order to an affiliate or as part of a merger, reorganization, financing, sale of assets, or transfer of the relevant business, provided that the assignee accepts the applicable obligations. 33.3 Severability If a provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions continue in effect. 33.4 No Waiver A delay or failure to enforce a right is not a waiver. A waiver is effective only when given in writing by an authorized representative and applies only to the specific matter identified. 33.5 Entire Agreement These Terms, the Privacy Policy, the Service Order, and any incorporated signed agreement form the entire agreement concerning the Service and replace prior discussions or representations about the same subject. 33.6 No Partnership or Agency These Terms do not create a partnership, joint venture, employment relationship, fiduciary relationship, franchise, or agency between you and HYEHOST. 33.7 No Third-Party Beneficiaries Except where Section 29.5 expressly allows protected parties to rely on a limitation, these Terms do not create rights for a person who is not a party. 33.8 Notices Operational, billing, security, abuse, and contractual notices may be sent through the client area, support system, account email address, or official website. A formal Notice of Dispute must follow Section 31.2. A support ticket or email does not replace formal service of legal process where law requires another method. 33.9 Electronic Agreement and Records You agree to electronic contracting, electronic notices, and electronic records. HYEHOST may retain records showing account creation, acceptance, order details, version, timestamp, IP address, payment, and Service use as evidence of the agreement. 33.10 Headings and Interpretation Headings are for convenience and do not limit meaning. Words such as "including" mean "including without limitation." A singular word includes the plural where the context requires it. 33.11 English Version The English version controls. A translation is provided only for convenience unless HYEHOST expressly agrees in writing that another language controls. 33.12 Contact Questions, complaints, legal notices permitted by these Terms, and policy concerns should be submitted through the HYEHOST support portal or to support@hyehost.org. THIS CONTRACT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES. By creating an account, ordering, paying for, accessing, or using a HYEHOST Service, you acknowledge that you have read, understood, and agreed to these Terms. Last updated: October 25, 2026
